Terms of Use

By downloading, installing, accessing, or using TripFacts (the “Service” or “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

  1. Acceptance of Terms

By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Legal Capacity. You must be at least the age of majority in your jurisdiction and not under 13 years of age to use the Service. If you are between 13 and the age of majority, you may use the Service only with parental or guardian consent where required by law.

Geographic Restrictions. The Service may not be available in all geographic locations. We reserve the right to restrict access based on location, legal requirements, or compliance obligations.

  1. Description of Service

Overview

TripFacts is a mobile application that provides users with location‑based access to curated facts, historical information, quizzes, and related informational content about places of interest.

Facts available through the Service are generated in advance using artificial intelligence (“AI”) based on predefined content categories and publicly available information. AI‑generated facts are not generated in real time based on a user’s location. Instead, the Service displays pre‑generated content by matching a user’s current or selected location with existing AI‑generated facts associated with that location.

Core Features

The Service may include:

  • Pre‑generated, AI‑created informational facts tied to locations
  • Category‑based content browsing (e.g., history, Architecture, Food & Cuisine, Nature & Landscape, Art & Museums, Festivals & Events, Local Phrases, Travel Tips & Hacks, Culture a& Traditions, Monuments, Music & Dance, Wildlife or similar topics)
  • Location‑based content display powered by Google Maps and Google Places APIs
  • Interactive quizzes and knowledge‑based challenges
  • Leaderboards visible to other logged‑in users
  • User account management and personalization
  • Subscription‑based access to basic and premium features

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

  1. AI‑Generated and Pre‑Generated Content

All facts and informational content available through the Service are generated in advance using AI based on user‑selectable categories and publicly available information.

  • Content is generated automatically and may be displayed without human review prior to display
  • User location is used only to determine which pre‑generated content is shown
  • Location data does not influence the generation of new content

AI‑generated content is inherently probabilistic and may be inaccurate, incomplete, outdated, misleading, or inapplicable to specific circumstances.

  1. Use of Publicly Available Information

The Service generates content based in whole or in part on publicly available information obtained from third‑party sources. Such information may be incomplete, outdated, or inaccurate.

TripFacts does not independently verify all source information and makes no guarantees regarding accuracy, completeness, or reliability. Inclusion of such information does not imply endorsement or validation.

  1. Location‑Based Content Display

TripFacts may access a user’s current, approximate, or selected geographic location to display relevant pre‑generated content.

  • The Service does not continuously track users
  • The Service does not collect location data in the background
  • Location may be accessed when the app is in use or when a user selects a location
  • No content is generated in real time based on live location data

Displayed content may not reflect real‑world conditions, recent changes, or current events.

  1. Informational Purposes and Non‑Reliance

All content provided through the Service is for general informational and educational purposes only and does not constitute professional, legal, medical, safety, travel, historical, or financial advice.

You agree not to rely on the Service for decisions involving:

  • Personal safety or emergency situations
  • Legal or regulatory compliance
  • Navigation or travel planning
  • Accommodations or transportation
  • Historical, cultural, or factual verification

Any reliance on the Service is at your own risk.

  1. Quizzes and Leaderboards

The Service may include interactive quizzes, challenges, and leaderboards designed for entertainment and educational purposes.

Quiz participation, scores, rankings, and leaderboard positions are generated automatically based on predefined rules and scoring logic. Leaderboards are visible to other logged‑in users and may display usernames, display names, scores, rankings, or similar non‑sensitive identifiers associated with user accounts.

TripFacts does not guarantee the accuracy, completeness, fairness, or availability of quiz content, scoring outcomes, or leaderboard rankings. We reserve the right to modify, suspend, reset, remove, or discontinue quizzes or leaderboards at any time, including for maintenance, fairness adjustments, abuse prevention, or operational reasons.

Quizzes and leaderboards do not constitute contests, sweepstakes, or games of chance and do not offer prizes, monetary value, or rewards unless expressly stated otherwise.

Fair Use and Anti‑Cheating

You agree not to manipulate, exploit, or interfere with quizzes, scoring mechanisms, or leaderboards, including through automation, multiple accounts, or unfair practices. TripFacts may remove scores, rankings, or accounts that violate these Terms.

  1. User Accounts

Account Creation

When creating an account, you agree to:

  • Provide accurate and current information
  • Keep account information up to date
  • Maintain confidentiality of credentials
  • Notify us of unauthorized access
  • Accept responsibility for all activity under your account

Account Security

You are solely responsible for maintaining account security. TripFacts is not liable for losses resulting from unauthorized access.

Account Termination

You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

  1. Subscriptions and Payments

TripFacts offers optional paid subscriptions for premium features. Pricing may vary by region.

  • Subscriptions automatically renew unless canceled before the renewal date
  • Payments are processed through the Apple App Store or Google Play Store
  • Cancellations must be completed through the applicable app store
  • No refunds except as required by law
  1. Acceptable Use Policy

You agree not to:

  • Use the Service for unlawful purposes
  • Copy, sell, sublicense, or exploit the Service or content
  • Reverse engineer, decompile, or create derivative works
  • Use automated systems to access the Service
  • Attempt unauthorized access to systems or accounts
  • Transmit malware or interfere with Service performance
  • Impersonate others or misrepresent affiliations
  1. Content and Intellectual Property

All content, trademarks, and materials are the exclusive property of TripFacts or its licensors and are protected by intellectual property laws.

We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial purposes only.

  1. Third‑Party Services

The Service integrates with third‑party services, including the Google Maps Platform. Your use of third‑party services is governed by their own terms and privacy policies.

TripFacts does not control and is not responsible for third‑party content, services, or practices.

  1. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

We do not warrant:

  • Uninterrupted or error‑free operation
  • Accuracy, completeness, or reliability of content
  • Correction of defects
  • That content is free from errors or omissions
  1. Limitation of Liability

To the maximum extent permitted by law, TripFacts shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability for any claim shall not exceed the greater of:

  • The amount paid by you in the last 12 months, or
  • USD $100
  1. Indemnification

You agree to defend, indemnify, and hold harmless TripFacts from claims arising out of:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of applicable laws
  • Your infringement of third‑party rights
  1. Termination

By You

You may stop using the Service at any time and delete your account as described in the Privacy Policy.

By Us

We may suspend or terminate access for violations of these Terms, fraudulent activity, or legal compliance reasons.

Effect of Termination

Your right to use the Service ends immediately. Paid fees are non‑refundable except as required by law.

  1. Dispute Resolution

Before filing a claim, you agree to attempt informal resolution by contacting us within 60 days.

Unresolved disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.

Class Action Waiver: Disputes must be brought individually and not as part of a class or representative action.

  1. General Provisions

Modifications. We may update these Terms at any time. Continued use constitutes acceptance.
Severability. If any provision is unenforceable, the remaining Terms remain in effect.
Assignment. You may not assign these Terms; we may assign them freely.
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and TripFacts.
